Terms and Conditions
1. Scope of Application
These Terms and Conditions apply to all orders placed through our online shop. Our shop is intended exclusively for consumers. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in exercise of their trade or independent professional activity.
2. Contractual Partner, Conclusion of Contract, Correction Options
The purchase agreement is concluded with Xsmodo.com. By placing products in our online shop, we make a binding offer to conclude a contract for these items. You may place our products in your cart without obligation and make changes at any time before submitting your binding order by using the correction tools provided during the ordering process. The contract is concluded when you click the order button to accept the offer for the products in your cart. Immediately after submitting your order, you will receive a confirmation by email.
3. Contract Language, Storage of Contract Text
The available languages for the conclusion of the contract are: German and English.
We store the contract text and send you the order details and our Terms and Conditions in text form. You can view the contract text in your customer login area.
4. Delivery Conditions
Delivery Options
We ship the products to the delivery address provided during the order process.
We offer delivery by shipping only. Self-collection of goods is unfortunately not possible.
5. Payment
5.1 Prices
The prices at the time of the order apply. These are total prices. We do not charge VAT.
5.2 Payment Methods
The following payment methods are generally available in our shop:
Credit Card
You enter your credit card details during the checkout process. Your card is charged immediately after placing the order.
Shopify Payments
Payment is made during checkout via the Shopify Payments gateway.
6. Warranty and Guarantees
6.1 Statutory Warranty Rights
The statutory warranty law applies.
6.2 Guarantees and Customer Service
Information about any applicable additional guarantees and their conditions can be found with the product and on dedicated information pages in the online shop.
7. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), available here.
Important Note: The ODR platform will be permanently discontinued on July 20, 2025. The submission of complaints via the platform will be disabled starting March 20, 2025.
We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
